		<abstract>Considering the high degree of fragmentation of the Brazilian Atlantic Forest and the relevant eco-hydrological functions of forests, it is necessary to demonstrate how the new Forest Code, Law 12,651 / 2012, representing reduction in legal protection of the forests remains and Areas of Permanent Preservation (APP). The new definition of hilltops APP in the current law has dramatically reduced this category of protection compared to the repealed resolution, CONAMA 303/2002. The area of interest is Sapucaí river basin, southeast region of Brazil, with the objective of presenting hypothetical scenarios of land use on hilltop APP, based on the new Forest Code (NCF) (scenario C1) and in the revoked resolution (scenario C2). In order to do so, the mapping of hilltop APPs was done according to the current legal definitions (C1) and revoked (C2) and the current land use map was used. The reduction of the area of the hilltop APP was 99% in the C1 compared to the C2. The land use scenario C1 represents the recovery of 10 ha of forest and C2 represents the recovery of 4.557 ha on the hilltop APP. Although much discussed in academy, the current legal criteria for definition of this category must be revised.</abstract>
